Pen, Shirts, iPod Touch and Sex

There is this  piece of news about a law professor from the National University of Singapore (NUS) who allegedly obtained sex and even a Mont Blanc pen, tailor-made shirts and iPod Touch from a former student in exchange for good grades.The professor had landed in court and that probably makes you ponder about the Buddhist Second and Third Precept:s: Adinnādānā veramaṇī sikkhāpadaṃ samādiyāmi. I undertake the training rule to abstain from taking what is not given and Kāmesumicchācāra veramaṇī sikkhāpadaṃ samādiyāmim I undertake the training rule to abstain from sexual misconduct. The student probably had given the professor the pen, shirts and iPod Touch willingly and there is no question about having  the second precept broken but do you think that the sex between the professor and his student or between any other two consenting adults for that matter, be considered a misconduct?
